1. Agreement to Terms

By accessing or using our service, you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the service.

VA Rating Assistant is provided for informational and educational purposes only. We are not affiliated with, endorsed by, or sponsored by the U.S. Department of Veterans Affairs.

  • No medical advice: We do not provide medical advice, diagnosis, or treatment.
  • No legal advice: We are not a law firm and we do not provide legal advice.
  • No VA representation: We do not represent claimants before the VA and we do not file claims on your behalf. VA Rating Assistant does not represent veterans before the Department of Veterans Affairs and is not a substitute for an accredited VSO, agent, or attorney. If you want representation, consult a VA-accredited representative, claims agent, or attorney via the VA OGC directory: https://www.va.gov/ogc/apps/accreditation/.

2. Description of Service

We provide an AI-powered service that analyzes medical documents to estimate VA disability ratings. Our service includes:

  • Document upload and storage
  • AI analysis of medical conditions
  • VA disability rating estimates
  • Detailed condition reports

3. Eligibility and Accounts

To use our service, you must:

  • Be at least 18 years old and not under 13
  • Register for an account with accurate information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access

We focus on U.S. users and do not target EU/UK residents.

4. Payment Terms

Payment terms for our service include:

  • All fees are charged in advance.
  • Subscriptions auto-renew unless you cancel.
  • Cancellation: You can cancel at any time. Cancellation takes effect at the end of your current billing period (access continues through the end of the period; no proration).
  • Refunds: No refunds except where required by law (or where we expressly agree in writing).
  • Prices may change with reasonable notice.
  • Payments are processed by Stripe. We do not store full card numbers (PAN) on our servers.

5. Acceptable Use

You agree to:

  • Provide accurate and complete information
  • Use the service only for lawful purposes
  • Not share account access with others
  • Not attempt to reverse engineer the service
  • Not upload dependent or family member information, or any content you do not have the right to share
  • Not use the service to provide legal advice or to represent others before the VA or any government agency

6. Intellectual Property

All content, features, and functionality of our service are owned by us and protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of our service without explicit permission.

7. Privacy; No Sale; No Targeted Advertising

Our collection and use of data are described in the Privacy Policy. We do not sell personal data and we do not use personal information for targeted or cross-context behavioral advertising.

8. De-identified, Anonymized, Pseudonymized Data

We may generate and use de-identified, anonymized, or pseudonymized data to operate, analyze, and improve the service. We will not attempt to re-identify such data, and third parties are prohibited from re-identification or secondary use without user consent.

9. Third-Party Service Providers

We rely on third-party service providers (as listed in the Privacy Policy) who are contractually bound to process data only under our instructions, maintain confidentiality and security, and refrain from disclosure, secondary use, or re-identification of de-identified data.

10. Data Retention and Deletion

Our retention practices are described in more detail in the Privacy Policy. In summary:

  • Uploaded documents (PDFs): Free and one-time plans retain uploaded documents for 90 days, then delete them unless you purchase an active storage subscription before the scheduled deletion date.
  • Storage subscription: A storage subscription extends retention beyond the base 90 days while active and paid. If the subscription ends and is not renewed, documents are scheduled for deletion at the end of the last paid retention window.
  • Reminder emails: We send reminder emails at 30, 15, 5, and 1 day(s) before deletion, and a confirmation email after deletion.
  • Derived data: Extracted/derived data that appears in your dashboard may remain available for the life of your account unless you delete your profile/account, subject to legal obligations.
  • Billing records: We may retain billing-related records for tax/accounting/chargeback defense, and some payment data is retained by Stripe under Stripe policies and legal obligations.
  • Legal holds: Where required, we may retain limited records and restrict access to the minimum necessary until the obligation ends.

11. Security and Breach Notification

We maintain safeguards appropriate to the nature of the data processed. If a data breach occurs, we will notify you and provide guidance as set forth in the Privacy Policy.

12. Dispute Resolution; Arbitration; Class Action Waiver

Please read this section carefully. It affects your legal rights.

Informal resolution first: Before initiating arbitration, you agree to contact us at support@varatingassistant.com and provide a brief written description of the dispute and the relief you seek, so we can attempt to resolve the issue.

Binding arbitration: If a dispute cannot be resolved informally, you and VA Rating Assistant agree that any dispute arising out of or relating to these Terms or the Service will be resolved by individual binding arbitration, and not in court, except that either party may seek injunctive or equitable relief in a court of competent jurisdiction to protect intellectual property or prevent unauthorized use.

Class action waiver: You and VA Rating Assistant agree that each may bring claims only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

Opt-out: You may opt out of arbitration by emailing support@varatingassistant.com within 30 days of first accepting these Terms, with the subject line "Arbitration Opt-Out" and your account email.

13. Limitation of Liability

We provide estimates based on available information but do not guarantee specific VA disability ratings. We are not liable for decisions made based on our estimates or for any consequential damages arising from the use of our service.

To the maximum extent permitted by law, our total liability for any claims arising out of or relating to the Service will not exceed the greater of $100 or the fees you paid us for the Service in the 12 months immediately preceding the event giving rise to the claim.

14. Ownership Change

If there is a merger, acquisition, reorganization, or sale of assets, we will notify you. You may download your information, close your account, and any new owner must adopt privacy/security protections at least as strong as ours before any transfer of personal information.

15. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of any material changes via email or through our service. Continued use of the service after changes constitutes acceptance of the new terms.

16. Governing Law; Venue

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-laws principles. Venue lies in state or federal courts located in Washington State.
